FICTITIOUS BUSINESS NAME (FBN) STATEMENT:
Prior to opening a business, a business name must be selected that is not already in use and then registered. Business and Professional Code 17918 specifies "No person transacting business under a fictitious business name contrary to the provisions of this chapter, or his assignee, may maintain any action upon or on account of any contract made, or transaction had, in the fictitious business name in any court of this state until the fictitious business name statement has been executed, filed, and published as required by this chapter. For the purposes of this section, the failure to comply with subdivision (b) of Section 17917 does not constitute transacting business contrary to the provisions of this chapter.

The first time filing fee for the Fictitious Business Name Statement is $23.00 for one business name and up to two registrants. The renewal filing fee for the Fictitious Business Name Statement is $18.00 for one business name and up to two registrants. There is an additional fee of $4.00 for both first time filing and renewal filing for each additional name and/or registrant.
Renewals:  A fictitious business name statement expires five years from the date it is filed in the office of the County Clerk. A new fictitious business name statement must be filed prior to that date if you intend to continue doing business under that name. A renewal only requires completion of the application and a $18.00 fee and $4.00 for each additional name/registrant.
A renewal does not require publication.
State law requires that within 30 days the registrant must publish a statement in a newspaper of general circulation in the county in which the principal place of business is located once a week for four successive weeks

PUBLICATION (B&P 17917) 

The registrant will publish the statement once a week for four successive weeks in a legally adjudicated newspaper of general circulation in the county where the fictitious business name is filed.  The first publication of the statement must appear in the newspaper within 30 days from the filing date or it becomes obsolete and must be refiled again with another filing fee.
If the county has no newspaper of general circulation, it will be published in an adjoining county.  If the registrant does not have a place of business in the state, publication will be made in Sacramento County.
An affidavit of publication shall be filed with the County Clerk where the fictitious business name statement was filed within 30 days after the completion of the publication

AS OF JULY 1st 2008 the fee for filing a “Fictitious Business Name Statement” is $40.00 for the first fictitious business name and $10.00 for each additional name filed on the same statement and doing business at the same location.  This includes one certified copy of the filing.  The $40.00 fee includes up to one partner with an additional fee of $10.00 for each additional partner thereafter.The fee for filing an “Abandonment of Fictitious Business Name” or “Withdrawal From Partnership Operating under a fictitious business name” is $40.00The fee to have a fictitious business name researched by mail is $5.00. The fee for a photocopy is $2.00 for the first page, $1.25 for each additional page.  A certified copy is $5.25 for the first page, $1.25 each additional page
