Who must file an FBN Statement and why?
In the case of a business owned by an individual, a “fictitious business name” is any name that does not include the last name (surname) of the owner, or which implies additional owners (such as "Company", "and Company", "and Sons", "Associates", etc.).
"Johnny Smith Catering" is not a Fictitious Business Name.
"Smith and Company Catering" is a Fictitious Business Name.
In the case of a corporation, limited liability company or limited partnership, a fictitious business name is any name other than the exact name that is on record with the Secretary of State's Office.
A Fictitious Business Name (FBN) Statement is a public record intended to make available to the public the identities of persons doing business under the FBN. Banks often insist on a copy of the FBN Statement before opening a commercial account to satisfy them that Joyce Smith has a right to deposit checks written to "Smith and Company Catering."
How long does a DBA last?
State law will determine the term for a FBN/DBA. In California, DBAs and FBN's are valid for five (5) years from the filing date.
You must have a stamped FBN statement form the County recorder's office in order to publish.

Fictitious Business Name Customer Alert -Misleading Business Solicitations
Bob Dutton, San Bernardino County Assessor-Recorder-County Clerk has been advised that solicitations are being sent to business owners alerting them that their Fictitious Business Name (FBN) Statements have expired. These solicitations are also being sent to business owners who have recently filed FBN Statements.
Renewal letters are mailed from the San Bernardino County Assessor-Recorder-County Clerk to business owners approximately one month before theFBN Statements are to expire. Although these solicitations appear to be official,they are not being made by the San Bernardino County Assessor-Recorder-County Clerk’s Office. Be aware that some of these solicitations mightcontain one or more of the following:
Effective January 1, 2014- Pursuant to Assembly Bill 1325, anyone filing a Fictitious Business Name Statement in person must present a valid government-issued photo identification, such as a driver's license, State-issued identification card, or passport.
